[2013] EWCA Civ 182

The Parole Board had power to exclude documents submitted by the secretary of state from consideration by the panel of the board deciding whether to recommend a prisoner's release on licence. The duty in the Criminal Justice Act 2003 s.239(3) to consider all such documents was imposed on the board, not on a particular panel of its membership.
