R (on the application of GENE GIBSON) v SECRETARY OF STATE FOR JUSTICE (2013)

PUBLISHED September 4, 2013

[2013] EWHC 2481 (Admin)

For the purposes of calculating the appropriate reduction of a term of imprisonment, which had been activated in default of full compliance with a confiscation order, in recognition of part payment towards the recoverable amount, the words "at the time the period of detention was imposed" in the Magistrates' Courts Act 1980 s.79(2) meant when the default term was activated, and not when the default term was originally fixed.
