Machines offering a chance-based virtual card game were gaming machines within the meaning of the Gambling Act 2005 as they were designed for use in the playing of a game of chance for a prize. That characteristic derived from the nature of the game, the way in which the machine enabled it to be played and the nature of the outcome, whose one likely possibility was the awarding of some prize.
