The restrictions under the Powers of Criminal Courts (Sentencing) Act 2000 s.83 on the magistrates' court power to impose custodial sentences on an unrepresented person were to be interpreted to mean that they applied to a defendant before the Crown Court on an appeal from a conviction by the magistrates' court.
