There were no circumstances in which it would be appropriate for a youth court to remit a defendant for sentencing to an adult magistrates' court under Powers of Criminal Courts (Sentencing) Act 2000 s.9 for offences that were triable only on indictment. The youth court could reclaim jurisdiction under Magistrates' Courts Act 1980 s.142 in order to sentence a defendant in circumstances where it had previously remitted him to the adult magistrates' court for sentencing.
