The secretary of state was not bound by the Criminal Justice Act 2003 to release a deportee early or at any date under the Early Removal Scheme; the Act was merely a facilitator of the scheme giving the secretary of state discretion to do so. The timetable in Prison Service Order 6000 was an internal administrative direction to the Prison Service and the secretary of state had given no guarantee that removal would take place in all cases within the particular time frame.
