Where the Crown Prosecution Service sought to replace a count of assault occasioning grievous bodily harm against the claimant with a count of assault occasioning actual bodily harm and the magistrates' court had previously dismissed a charge of actual bodily harm based on the same facts the claimant was entitled to rely on the defence of autrefois acquit and the magistrates' court had erred in not allowing him that defence.
