A magistrates court did not err in refusing an order under the Children and Young Persons Act 1933 s.39 prohibiting publication of a mother's conviction under the Licensing Act 1902 s.2(1) for being drunk in a public place while in charge of a child under the age of seven. The balance of competing principles under the European Convention on Human Rights 1950 art.10 and art.8 came down firmly in favour of open justice under art.10.
