Provided that there was sufficient evidence to commit to trial then it was unnecessary for the justices to consider if the entirety of a statement would be admissible at trial. The prosecution could choose which witnesses it intended to rely on for committal proceedings. The proper procedure for challenging a committal decision was by judicial review.
