Court of Appeal, Criminal Division Published January 5, 2012 Regina v S and HBefore Lord Justice Hooper, Mr Justice Supperstone and Sir Geoffrey Grigson Judgment December 13, 2011 The criminal offence of ?encouraging or assisting? the commission of offences ?believing one or more will be committed?, contrary to section 46 of the Serious Crime Act 2007, was not vague or uncertain and was therefore not incompatible with a defendant?s rights to a fair trial and to be punished lawfully under articles 6 and 7 of the European Convention on Human Rights.
