[2008] EWHC 1357 (Admin)

A judge had properly made an order sending a case to the Secretary of State for the Home Department for her decision as to whether the appellant should be extradited to the United States in relation to terrorism-related charges, and the subsequent decision of the secretary of state to extradite him was unassailable. An allegation by the appellant that the evidence against him was tainted by torture, contrary to the European Convention on Human Rights 1950 art.3, was unsupported by evidence.
