The defendants in a libel action could not rely on the defence of qualified privilege based on responsible journalism as they had not acted responsibly in communicating information contained in a book about the claimant. Nor could the defendants rely on the statutory defence of privilege accorded to fair and accurate reports of legal proceedings as the account of the criminal trial in the book was not a fair presentation of what had occurred in court.
