An allegation in a devolution minute that the police had breached the appellant's rights under the European Convention on Human Rights 1950 did not raise a devolution issue within the Scotland Act 1998 Sch.6 Pt I para.1(d) as the police were not members of the Scottish Government; the Supreme Court therefore had no jurisdiction to determine it.
