Where receivership and freezing orders had been made in respect of numerous assets owned by the former chairman of a bank who was alleged to have misappropriated bank assets worth hundreds of millions of dollars, the court ordered that there should be a trial to determine whether the transfer of beneficial ownership of shares in a particular company to a third party was bone fide, or whether the transfer was fictitious and amounted to a breach of the court orders.
