In deciding not to re-release a prisoner on licence, having considered some information certified as confidential under the Parole Commissioners' Rules (Northern Ireland) 2009 r.9(1), the Parole Commissioners had failed sufficiently to safeguard against the lack of full disclosure. The general allegations made in the open material lacked the specificity required by the European Convention on Human Rights 1950 art.5(4) to enable challenge by the prisoner.
