The Crown Court had not erred in placing the burden of proof on the appellant and was not required to give reasons for disbelieving the appellant's defence where the reasons for its decision were obvious. Section 172 Road Traffic Act 1988 was not incompatible with the right against self-incrimination under Art.6 European Convention on Human Rights.
