Whether a motorist's option to have a blood or urine test under ss.7 and 8 of the Road Traffic Act 1988 can be fairly assessed by the motorist if he has not been told that he has the right to refuse on medical grounds, and that those grounds will be determined by a doctor who will be responsible for administering the test.
