A magistrates' court had misapplied the subjective test of recklessness in R. v G [2003] UKHL 50, [2004] 1 A.C. 1034, when deciding that a tenant farmer had recklessly destroyed a badger sett contrary to the Protection of Badgers Act 1992 s.3.
