The absence in a European arrest warrant of a reference to a right of retrial or appeal against a conviction in absentia, and of the relevant timescales, did not compel a refusal to execute the warrant. A second decision to extradite a person was not res judicata, as earlier extradition proceedings had been withdrawn by consent without deciding the merits.
