The Crown court was not permitted to entertain a challenge to the approval of an intoximeter device for various reasons, including that the reliability of a reading was always open to challenge by way of admissible evidence, and because Parliament could not have intended for every defendant to have the right to challenge the lawfulness of the Secretary of State for the Home Department's approval of a device.
