In the circumstances, the use of the words "bloody foreigners" immediately prior to committing an offence of criminal damage were capable of being construed as expressing hostility based on a victim's membership or presumed membership of a racial group within the meaning of the Crime and Disorder Act 1998 s.28(1)(a).
