The magistrates had erred in law in concluding that the defendant's request to see a solicitor or alternatively a law book to verify the legality of the police request for a specimen of breath had amounted to a reasonable excuse under s.7 Road Traffic Act 1988 for failing to provide the specimen; Smith v. Hand (1986) RTR 265 distinguished.
