Whilst the respondent had advanced the deposit necessary for his ex-wife to exercise the right to buy the subject property, he was not the directing mind of a transaction which was intended to benefit him alone because his ex wife had repaid the deposit monies and had a mortgage in her sole name, as a result the property could not be seized as part of confiscation proceedings against the respondent.
