Where the position of a solicitors firm that had written an allegedly libellous letter on behalf of a client could raise questions of some difficulty as to matters of both law and fact and the possibility could not be excluded that the client might decide to waive privilege in respect of the communications that led to the writing of the words complained of, summary judgment in favour of the solicitors firm was inappropriate.
