In criminal proceedings where there was evidence available to satisfy a fact finder to the criminal standard of proof that a defendant had committed the offences, there was no set evidential procedure that required a fact finder to give any evidential weight to speculative possibilities as to how an offence might have occurred and such speculative possibilities could be safely dismissed.
