The Regulation of Investigatory Powers Act 2000 s.17(1) did not prevent a court, in a criminal case, from conducting an enquiry into whether an interception of a telephone conversation had taken place on a public or private telecommunications system and, if the latter, whether the interception had been by, or with the consent of, the person with the right to control the operation or use of that system.
