For the purposes of the Criminal Justice Act 2003 Sch.21 para.5(2)(e), sadistic conduct did not require a sexual element. The fundamental question however was whether, sadistic or not, the conduct of the defendants in a murder was serious enough to warrant a 30 year starting point.
