[2004] EWHC 2415 (Admin)

The strict requirements of the Police and Criminal Evidence Act 1984 and the Codes of Practice had to be complied with prior to an intended search notwithstanding that the person apprehending the suspect was obviously a police officer and that that officer had genuine concerns about another officer's safety. A failure to comply meant that the officer was acting outside the execution of his duties.
