A magistrates' court was correct to hold that an individual had a case to answer to two charges of being drunk on a highway whilst in charge of a child under seven contrary to the Licensing Act 1902 as, although she denied that she was present with the children at the time of the incident, there was sufficient evidence adduced by the prosecution to support the contention that she was indeed the woman who had been in charge of the children at the relevant time.
