On a confrontation identification it was not a breach of the Police and Criminal Evidence Act 1984 Code D to bring one twin brother and then the other before a witness as the effect was not to draw the attention of the witness to the identity of one twin by first seeing the other. Until the witness had identified a person as the person she had seen at the scene of crime the identitiy of that person was not known.
