[2013] EWCA Crim 1135
For the purposes of making an order under the Children and Young Persons Act 1933 s.39 in criminal proceedings, a child or young person was not "concerned in the proceedings" unless they were the victim of an alleged offence, a defendant or witness. The wording did not extend to them simply because they might be concerned in the more general sense of being affected.
