An application, made the day before trial, to prefer a voluntary bill of indictment was refused where the delay in making the further charge was due to the inefficiency of the Crown in bringing the further charge, the defendant would have been deprived of challenging the sufficiency of the evidence before the start of the trial, and the application had been made on short notice.
