PUBLISHED June 2, 2000A submission that the Court of Appeal (Scotland) had purported to amend s.124(2) Criminal Procedure (Scotland) Act 1995 and usurp the functions of the Scottish Parliament was not a devolution issue which fell to be decided by the Privy Council. The power of the instant court to decide whether a minute raised a devolution issue was inherent in its jurisdiction under the Scotland Act 1998.
