A submission that the Court of Appeal (Scotland) had purported to amend s.124(2) Criminal Procedure (Scotland) Act 1995 and usurp the functions of the Scottish Parliament was not a devolution issue which fell to be decided by the Privy Council. The power of the instant court to decide whether a minute raised a devolution issue was inherent in its jurisdiction under the Scotland Act 1998.
