A Crown Court judge had power to extend the 42-day time limit for disclosure of evidence to the defence in cases sent to the Crown Court under s.51 Crime and Disorder Act 1998 in an appropriate case, even when application for an extension was not made during that period. The 42-day period laid down in reg.2 Crime and Disorder Act 1998 (Service of Prosecution Evidence) Regulations 2000 SI 1998/3115 was not mandatory.
