A magistrates' court erred in allowing a charge to be amended after the six-month time limit imposed by the Magistrates' Courts Act 1980 s.127 as while the fresh charge arose from the same misdoing allowing the amendment was contrary to the interests of justice as the Prosecution had failed to timeously seek an amendment to the charge.
