In order to fix a company with intention to deceive for the purposes of a prosecution in respect of an offence of allowing a sub-contractor to use an operator's licence under the Goods Vehicles (Licensing of Operators) Act 1995 s.38, it was necessary to show that a director or office-holder exercising general authority within the company had knowledge of the facts constituting the offence.
