A magistrates' court had erred in allowing an information to be amended after the six-month time limit imposed by the Magistrates' Courts Act 1980 s.127 as, while the fresh charge arose from the same misdoing, namely the keeping of a dog contrary to a disqualification order, allowing the amendment was contrary to the interests of justice as the defendant faced imprisonment under the Protection of Animals (Amendment) Act 1954 s.2 whereas previously he had only faced a fine.
