The test of "concern for the welfare of someone within the premises" was not sufficient to justify entry by the police into premises by force without a warrant under the Police and Criminal Evidence Act 1984 s.17(1)(e), and by doing so they had not acted in the execution of their duty, as such entry was limited to cases where it was apprehended that something serious was otherwise likely to occur or had occurred.
