The conduct of an Australian in Afghanistan, where he was alleged to have trained with terrorists, could not constitute disloyalty or disaffection towards the United Kingdom, for the purposes of the British Nationality Act 1981 s.40(3)(a) as originally enacted, a state of which he was not then a citizen, to which he owed no duty and on which he made no claim.
