In relation to the offence of aggravated trespass, the phrase "lawful activity" in the Criminal Justice and Public Order Act 1994 s.68 was limited to acts or events that were integral to the activity carried out on the land trespassed upon. It was thus no defence for a trespasser to assert that the occupier of the land was engaged in criminality that was merely incidental or collateral to, or remote from, that activity.
