In establishing a regime for pursuing the proceeds of crime the Criminal Justice Act 1988 Pt VI assumed the ordinary rules as to how a defendant had an interest in property. That meant that the prosecution had to analyse how under ordinary principles of property and trust law a defendant acquired and held property which was said to be subject to the confiscation order.
