[2006] EWCA Crim 3062

The Court of Appeal substituted its own decision for the decision of a judge in confiscation proceedings since there had been an appearance of bias. The fact that a defendant had not been represented did not amount to unfairness where the defendant had made his own decision to withdraw instructions from his solicitors.
