Where a defendant made false allegations of abuse against a person who it was subsequently discovered was dead at the time of the allegations, the judge was right to allow the indictment to be amended to reflect the offence of attempting to pervert the course of justice. The conviction was safe as the vice of the offence was the attempt and not the carrying through of the offence.
