A judge had lawfully exercised his discretion under the Police and Criminal Evidence Act 1984 s.78 by allowing evidence of a co-accused's guilty pleas to be admitted during a trial for attempting to evade a liability by deception. It had been open to him to conclude that the jury was at risk of being misled if the evidence was not admitted.
