[2010] EWCA Crim 28

In relation to the consequences of a breach of the Criminal Justice Act 1988 s.72A(9), the decisions in R. v Threapleton (Michael) (Costs: Confiscation Order) [2001] EWCA Crim 2892, [2003] 3 All E.R. 458, R. v Jones (Alan) [2004] EWCA Crim 2213, R. v Ghebremariam (Jediyon) [2006] EWCA Crim 91, and R. v Khan (Mahmood) [2007] EWCA Crim 718 were all inconsistent with the approach taken in R. v Soneji (Kamlesh Kumar) [2005] UKHL 49, [2006] 1 A.C. 340 and were to be disregarded.
