Failure to disclose the existence of a video tape would not vitiate criminal proceedings if the tape would have had no effect on the trial at all, or if there was nothing on the tape to assist either side and no reason to suppose that the absence of the tape had affected the fairness of the trial or rendered the conviction unsafe.
