[2002] EWHC 2046 (Admin)

Even where there was no direct and specific evidence of a child victim's state of mind at the prospect of giving evidence, beyond a statement of being happy to attend court, magistrates were entitled to draw the inference that a victim who knew his assailant would not be able to give evidence without feeling intimidated.
