A defendant could appeal to the Court of Appeal under the Sexual Offences Act 2003 s.110(3)(a) against the refusal of the Crown Court to vary a sexual offences prevention order. On such an appeal the Court of Appeal could, by virtue of the Criminal Appeal Act 1968 s.11(3), quash the order and make another appropriate order, as it was an appeal against sentence.
