Where evidence of diminished responsibility was both unanimous and accepted by the Crown and it was undisputed that the appellant's decision not to allow the issue of diminished responsibility to be adduced at trial was significantly affected by his mental illness then the Court of Appeal would allow that evidence to be adduced on appeal.
