The maximum term of 10 years' imprisonment in default of payment of a confiscation order imposed on the defendant would also have been applicable in the case of a defendant whose benefit and disposable property greatly exceeded his. It followed that the default sentence should have been less than the maximum and the 10-year term would be substituted by one of eight years' imprisonment in default of payment.
